Petition Legal Information:

Per NRS 295.095, any five registered voters of Douglas County may commence initiative or referendum proceedings by filing with an affidavit with the Douglas County Clerk stating they will constitute the petitioners’ committee and be responsible for circulating the petition and filing it in the proper form, stating their names and addresses, and specifying the address to which all notices to the committee are to be sent, and setting out in full the proposed initiative ordinance or citing the ordinance sought to be reconsidered.

Once an affidavit is submitted by a petitioners’ committee, the Douglas County Clerk is responsible for verifying that all five members of the petitioners’ committee are registered voters as required by Nevada law. The Clerk-Treasurer’s sole role upon submission of the affidavit is administrative.  The factual accuracy of the petition, the stated financial effect, description, legal sufficiency, or legality of the petition is not verified by either the Douglas County Clerk Treasurer or the Douglas County District Attorney’s Office.
